Booking Terms and Conditions – Bush Rover Safaris

1. Definitions

  • COMPANY: Delta tourism consortium (Pty) Ltd trading as Bush Rover Safaris, including its agents and associates.

  • CUSTOMER: The individual or entity booking the safari.

2. Authority to Book

The CUSTOMER warrants that they have the authority to enter into this booking agreement on behalf of themselves and all individuals included in the booking.

3. Booking Acceptance and Payment

  • Acceptance: The COMPANY’s acceptance of the booking will be evidenced by:

    • Sending an invoice to the CUSTOMER or their agent, indicating the total amount due.

    • Receiving a deposit payment from the CUSTOMER equal to 30% of the safari fee upon receipt of the invoice.

  • Cancellation: The CUSTOMER cannot withdraw or cancel the booking without the COMPANY’s written consent.

4. Contract Confirmation

In the absence of a signed booking form, the invoice will serve as confirmation of the contract between the COMPANY and the CUSTOMER.

5. Payment Terms

  • Full Payment: The full amount due must be paid to the COMPANY at least 30 days prior to the departure date.

  • Cancellation Penalties: If the CUSTOMER cancels the booking, the deposit will be forfeited, and the following cancellation penalties apply:

    • 30 – 45 days before departure date: 40% of the total safari fee.

    • 21 – 29 days before departure date: 70% of the total safari fee.

    • 0 – 20 days before departure date: 100% of the total safari fee.

6. Safari Price and Exclusions

Safari prices include only what is specified for each tour. The following are not included:

  • Visas

  • Vaccinations

  • Insurance

  • Other items required for the safari.

7. Travel Documents

The CUSTOMER is responsible for ensuring they possess all necessary travel documents, including health certificates and other required documents.

8. Travel Insurance

The CUSTOMER must have adequate travel insurance for the duration of the safari. The COMPANY reserves the right to request proof of such insurance.

9. Itinerary Variations

The COMPANY may vary the safari price and itinerary without prior notice to the CUSTOMER, at its discretion. This will only occur if the itinerary remains substantially similar to the original plan. Such variations do not constitute grounds for cancellation or alteration of the contract.

10. Accommodation Changes

The COMPANY will endeavor to provide the planned accommodations. If changes are necessary, the CUSTOMER will not be entitled to any compensation from the COMPANY.

11. Physical Fitness

The CUSTOMER acknowledges that the proposed itinerary requires a degree of physical fitness and endurance. The CUSTOMER is responsible for ensuring they are medically fit to participate in the safari.

12. Safari Risks

The CUSTOMER acknowledges that inherent dangers and risks are associated with the safari. The CUSTOMER agrees to accept all risks connected with or arising from any aspect of the safari.

13. Indemnification

The CUSTOMER indemnifies and holds harmless the COMPANY, its employees, agents, or affiliates, against any loss or injury sustained during the safari, regardless of the cause, including any negligent act or omission by the COMPANY, its management, employees, agents, or associates. The CUSTOMER waives all rights of any nature against the COMPANY.

14. Tour Leader

The COMPANY will appoint a tour leader to oversee the safari and all related matters. The CUSTOMER agrees to comply with the tour leader’s legitimate instructions.

15. Customer Conduct

  • The CUSTOMER agrees to comply with the COMPANY’s requirements regarding conduct.

  • The CUSTOMER will not behave in a way that constitutes a nuisance to others on the safari.

  • If the CUSTOMER behaves in a disruptive manner, the COMPANY may terminate the booking, refuse further participation in the safari, and require the CUSTOMER to make their own travel arrangements. In such cases, the CUSTOMER will not be entitled to any refund or compensation.

16. Photography and Film

The COMPANY has the right to use any photographs or film produced during the safari for any purpose without requiring permission or payment from any CUSTOMER.

17. Governing Law

This contract is deemed to be concluded in Maun, Botswana, and will be interpreted according to the laws of Botswana.

18. Entire Agreement

These conditions constitute the entire terms of the agreement between the parties. No other terms or conditions apply.
